Agreement to Terms

By accessing or using IQ Auto ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

IQ Auto is a SaaS platform that provides AI-powered quality auditing for digital vehicle inspections. The Service analyzes inspection reports, identifies quality issues, detects fraud patterns, and identifies revenue opportunities.

Account Registration

Eligibility

• You must be at least 18 years old
• You must represent a legitimate auto repair business
• You must provide accurate and complete information

Account Security

• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access

Subscription and Billing

Free Tier

• All users start with 10 free lifetime audits
• No credit card required
• Full access to all features during free tier
• Upgrade to a paid plan anytime for additional audits

Paid Subscription

• Subscription begins immediately upon selecting a paid plan
• Billing is monthly, charged on the same day each month
• All fees are in US Dollars (USD)
• Payment is processed securely through Stripe

Plan Tiers

• Starter - $99/month (up to 50 inspections/day)
• Professional - $149/month (up to 100 inspections/day)
• Enterprise - $249/month (100+ inspections/day)

Overages

If you exceed your plan's inspection limit, we will contact you to upgrade your plan. You will not be charged for overages without explicit approval.

Refunds

• 30-day money-back guarantee on your first paid month
• No refunds for partial months (except first 30 days)
• Refunds are processed within 5-7 business days

Acceptable Use Policy

You May

• Use the Service for legitimate business purposes
• Connect your shop management system via authorized integrations
• Upload inspection files (CSV, PDF) for auditing
• Share audit reports within your organization

You May Not

• Resell or redistribute the Service
• Reverse engineer or attempt to extract source code
• Use the Service for competitive analysis or benchmarking
• Upload fraudulent or fabricated inspection data
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems

Data Ownership and Usage

Your Data

• You retain ownership of all inspection data you upload
• We do not claim ownership of your data
• You can export or delete your data at any time

Our Use of Data

• We use your data solely to provide the Service
• We may use anonymized, aggregated data to improve our AI models
• We will never sell your data to third parties

Service Availability

Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance.

Data Backup

We perform daily backups of all data. However, you are responsible for maintaining your own backups of critical data.

Limitation of Liability

Service Provided "As Is"

The Service is provided "as is" without warranties of any kind, express or implied.

AI Accuracy

While we strive for high accuracy, AI audit results are not guaranteed to be 100% correct. Human review is recommended for critical decisions.

Business Decisions

You are solely responsible for business decisions made based on audit results. We are not liable for:

• Lost revenue from missed recommendations
• Customer disputes arising from inspection quality
• Regulatory penalties or legal issues
• Damage to business reputation

Maximum Liability

Our maximum liability for any claim is limited to the amount you paid us in the past 12 months, not to exceed $1,000.

Termination

By You

• You may cancel your subscription at any time from account settings
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months (except first-month money-back guarantee)

By Us

We may suspend or terminate your account if:

• You violate these Terms
• Payment fails after multiple attempts
• You engage in fraudulent or illegal activity
• You abuse the Service or harm other users

Data Deletion

Upon termination, your data will be:

• Retained for 30 days (you can request export during this time)
• Permanently deleted after 30 days
• Removed from backups within 90 days

Intellectual Property

Our IP

• IQ Auto name, logo, and branding are our trademarks
• Our software, AI models, and algorithms are proprietary
• You may not copy, modify, or distribute our technology

Feedback

If you provide feedback or suggestions, we may use them without compensation or attribution.

Dispute Resolution

Informal Resolution

Before filing a claim, please contact us at support@iq-auto.com to resolve the issue informally.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service constitutes acceptance of updated Terms.

Severability
